Uncontested divorce and notarial divorce in Spain (Garraf)

An uncontested divorce (divorcio de mutuo acuerdo) is the fastest and cheapest way to divorce in Spain: both spouses, with a single lawyer, file a settlement agreement at the court in Vilanova i la Geltrú or, if there are no minor children, sign it directly before a notary. Three months must have passed since the wedding and you must agree on the essentials: children, home, maintenance, assets. We draft the agreement and the parenting plan, in English, and accompany you to the judgment or the deed. Flat fee on request at 618 799 647.

Requirements

  • At least three months since the marriage; no grounds need to be given.
  • Both spouses agree, or one applies with the other’s consent.
  • A settlement agreement (convenio regulador) covering custody, contact, child maintenance, use of the family home, spousal maintenance where applicable, and division of joint assets.
  • In Catalonia, with minor children, a parenting plan (pla de parentalitat) describing how parental responsibilities will be organised in practice.

Uncontested divorce at the court in Vilanova i la Geltrú

  1. First meeting (in person or by video call). We listen to both spouses, list the points agreed and those still open. If there is a specific disagreement, we offer mediation before any contested route.
  2. Drafting the agreement and parenting plan.Clear, complete, enforceable, and drafted so it can be recognised in your home country.
  3. Filing at court. One lawyer and one procurador for both. With minor children, the public prosecutor reviews the agreement.
  4. Ratification. Both spouses confirm the agreement before the court in a brief appearance.
  5. Judgment and registration. The court grants the divorce; we handle registration in the Spanish civil registry and tell you how to record it abroad.

Timelines depend on the court’s workload, but a well-prepared uncontested divorce is usually resolved in a few weeks or months, compared with years for a contested one.

Divorce before a notary

Since 2015, couples with no minor children (and no adult children with modified capacity dependent on their parents) can divorce before a Spanish notary. Both spouses sign the deed with the compulsory assistance of a lawyer; the divorce takes effect immediately. It is the fastest route: often a matter of days once the agreement is finalised.

The notary must be that of the last joint home or of either spouse’s home. We draft the agreement, review the deed with the notary’s office of your choice in Sitges, Vilanova or Vilafranca and accompany you at the signing. Adult children who are financially dependent must consent to the measures affecting them.

International couples: what to check

For a British-Spanish, Irish, American or mixed couple, several questions arise before signing: which court has jurisdiction (generally the habitual residence), which law governs the matrimonial property regime and maintenance, and how the judgment or deed will be recognised in the other country. Within the European Union recognition is largely automatic; for the United Kingdom, the United States and other countries, additional steps may be needed. We draft the agreement with this in mind.

What the flat fee includes

  • Initial meeting and advice on the measures.
  • Drafting of the settlement agreement and, where applicable, the parenting plan.
  • Joint application and procurador, or assistance at the notary.
  • Follow-up to the judgment or deed and registration in the Spanish civil registry.

Not included: complex division of assets (companies, several properties), mediation, notary or registry fees, and recording the divorce abroad, all detailed in the written quote.

Frequently asked questions

How long does an uncontested divorce take in Vilanova i la Geltrú?

Depending on the court, a few weeks to a few months once the agreement is finalised. Before a notary, with no minor children, a few days.

Can we use the same lawyer?

Yes, that is the norm and the most economical option in an uncontested divorce. The lawyer drafts the agreement for both and files the joint application.

We have minor children. Can we divorce before a notary?

No. With minor children the divorce must go through the court, with the public prosecutor’s review, and a parenting plan is required.

My spouse lives in the UK. Is it possible?

Yes. We prepare the agreement by video call and, if needed, a power of attorney avoids one spouse having to travel.

Can the agreement be changed later?

Yes, if circumstances change substantially (job, income, relocation, children’s needs), through a variation procedure, which can also be by mutual agreement.

What is the price?
